Welcome to Quizva. These Terms of Service ("Terms") govern your access to and use of Quizva’s website, apps, and related services (the "Services"). By using the Services, you agree to these Terms and our Privacy Policy and Cookies Policy. If you are using the Services on behalf of an organization (e.g., a school), you represent that you have authority to bind that organization.

1. Accounts and eligibility
  • You must provide accurate information and keep your credentials secure.
  • You are responsible for all activity under your account.
  • Where required by law, student accounts must be created or supervised by an educator or parent/guardian.
2. Acceptable use
  • Do not misuse the Services, reverse engineer, disrupt, or attempt unauthorized access.
  • Do not upload unlawful, infringing, or harmful content.
  • Respect others and comply with applicable laws, including Canadian privacy and anti‑spam laws.
3. Content and licenses
  • You retain ownership of content you submit. You grant Quizva a worldwide, non‑exclusive, royalty‑free license to host, use, reproduce, and display that content solely to operate and improve the Services.
  • You must have rights to the content you submit.
  • Quizva content (including software, UI, and trademarks) is owned by Quizva or its licensors and is provided under a limited, non‑transferable license to use the Services.
4. Subscriptions, payments, and refunds
  • Paid plans may auto‑renew unless canceled per your plan’s terms.
  • Taxes may apply based on your location. Pricing and features may change with notice.
  • Refunds, if any, are provided per the plan or as required by law.

5. Privacy and data protection

We process personal information in accordance with our Privacy Policy and applicable Canadian laws (e.g., PIPEDA). We implement safeguards appropriate to the sensitivity of data. If you are an educator or institution, you are responsible for obtaining any required consents and providing notices to students or guardians.

6. Educational use and student data

Where the Services are used in an educational context, Quizva acts as a service provider to the institution. The institution controls student data and determines retention, deletion, and access rights, subject to applicable law and our agreement with the institution.

7. Third‑party services

The Services may link to or integrate with third parties. Quizva is not responsible for third‑party content or practices. Your use of third‑party services is subject to their terms and policies.

8. Disclaimers

The Services are provided "as is" without warranties of any kind, to the fullest extent permitted by law. Quiz content may not be error‑free or suitable for every purpose. You use the Services at your own risk.

9. Limitation of liability

To the extent permitted by law, Quizva will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill. Our aggregate liability arising from or relating to the Services shall not exceed the amounts paid to Quizva in the twelve (12) months preceding the claim.

10. Indemnity

You agree to indemnify and hold Quizva harmless from claims arising out of your use of the Services, your content, or your violation of these Terms or applicable law.

11. Termination

We may suspend or terminate your access for violation of these Terms or risk to the Services. You may stop using the Services at any time. Sections intended to survive termination will continue to apply.

12. Changes

We may modify these Terms. If changes are material, we will provide notice (e.g., by email or in‑product). Your continued use indicates acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of laws. The courts located in Ontario will have exclusive jurisdiction, except where prohibited by applicable law.
